1. Agreement to Terms

By accessing or using esharp.store ("the Site"), you agree to these Terms of Service. If you do not agree, do not use the Site.

ESHARP is an online store selling hijabs and headscarves, with an optional augmented reality (AR) virtual try-on feature. The Site is operated by Harvto LLC, a California limited liability company.

2. Your Account

You may create an account to place orders, track shipments, and save preferences. You are responsible for keeping your login credentials secure. If you suspect unauthorized access, contact us immediately at support@esharp.store.

We may suspend or close accounts that violate these terms or show signs of fraud.

3. Products and Purchases

Pricing

All prices are listed in US Dollars (USD) unless otherwise stated. Prices may change without notice, but changes will not affect orders already confirmed.

Orders

When you place an order, you are making an offer to purchase. We confirm your order via email. We reserve the right to cancel an order if a product is unavailable, mispriced, or we suspect fraud.

Payments

Payments are processed securely through Shopify Payments and Stripe. We never store your full credit card number.

Custom and Personalized Orders

Custom-designed or personalized hijabs are non-refundable once production has begun, unless the item is defective. See our Returns and Refunds Policy for details.

4. AR Virtual Try-On Feature

ESHARP offers an optional augmented reality try-on feature that lets you see how a hijab may look on you using your device camera.

How it works:

The AR feature requires access to your device camera.
All camera processing happens entirely on your device. No images, video, or facial data are ever sent to our servers. The AR engine runs locally in your web browser.
You must grant camera permission before the feature activates. You can revoke this permission at any time through your browser settings.
The AR try-on is a visualization tool. It provides an approximate representation and is not a guarantee of exact fit, color, or appearance.

You are not required to use the AR feature. You can browse and purchase hijabs without it.

5. Shipping and Delivery

We currently ship to the United States. Shipping times and costs are displayed at checkout. Estimated delivery times are not guaranteed.

Risk of loss passes to you upon delivery to the carrier.

6. Returns and Refunds

Returns are governed by our separate Returns and Refunds Policy. Key points:

14-day return window from the date of delivery
Items must be unworn, unwashed, and have original tags attached
Custom/personalized orders are non-refundable unless defective
Refunds are processed within 5-7 business days after we receive the returned item

7. Intellectual Property

All content on the Site - including brand names, logos, 3D models, AR effects, product images, and website design - is owned by Harvto LLC or its licensors. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.

Custom design uploads: If you upload a custom design for a personalized order, you grant us a limited license to use that design solely to fulfill your order. We do not claim ownership of your uploaded designs.

8. Prohibited Uses

You agree not to:

Use the Site for any unlawful purpose
Attempt to access other users' accounts or our systems without authorization
Scrape, crawl, or use automated tools to extract data from the Site
Upload malicious code or interfere with the Site's operation
Resell products purchased from ESHARP without our written consent

9. Limitation of Liability

To the maximum extent permitted by law, Harvto LLC is not liable for indirect, incidental, special, or consequential damages arising from your use of the Site, including but not limited to: lost profits, data loss, or damages from reliance on the AR try-on feature.

Our total liability for any claim related to the Site or your purchases will not exceed the amount you paid for the specific order in question.

10. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available." We make no warranties, express or implied, regarding the Site's availability, accuracy, or fitness for a particular purpose.

The AR try-on feature is provided as a convenience. We do not warrant that the AR visualization will exactly match the actual product in color, fit, or draping.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Site will first be addressed through good-faith negotiation. If unresolved within 30 days, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in California.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page. If we make material changes, we will notify registered users by email. Continued use of the Site after changes are posted constitutes acceptance.
